National Legal Services Authority (NALSA): Ensuring Equal Access to Justice
The National Legal Services Authority (NALSA) was constituted under the Legal Services Authorities Act, 1987 and came into force in 1995. Its mission is to provide free legal services to the weaker sections of society and to promote access to justice for all through legal aid and the organisation of Lok Adalats.
Constitutional and Legal Framework
NALSA derives its constitutional legitimacy from Article 39A, which mandates the State to ensure free legal aid for promoting justice on the basis of equal opportunity. Articles 14 and 22(1) further reinforce the principle of equality before the law.
Structure and Functioning
NALSA operates through a hierarchical structure:
* National Level: Headed by the Chief Justice of India (Patron-in-Chief).
* State Level: Led by the Chief Justice of the respective High Court.
* District and Taluka Levels: Chaired by District Judges and Senior Civil Judges, respectively.
NALSA lays down policies and principles for legal services, funds State Legal Services Authorities, and monitors implementation.
Free Legal Services
Eligible groups include women, children, SC/ST members, disabled persons, industrial workers, disaster victims, persons in custody, and those below the income threshold (Rs. 1 lakh for lower courts and Rs. 5 lakh for the Supreme Court). Services include:
* Court and process fee payments
* Legal representation
* Document preparation and translation
* Certified document procurement
Lok Adalats and ADR
NALSA organises Lok Adalats, which are alternative dispute resolution forums for amicable settlements. Awards are legally binding, with no appeal provision. E-Lok Adalats were introduced to enhance access during the COVID-19 pandemic.
Legal Awareness
NALSA conducts legal literacy programmes, especially in rural areas and educational institutions, to empower citizens and prevent legal issues.
NALSA plays a vital role in democratizing legal access, especially for the underprivileged. Through its structured legal aid and awareness programs, it strengthens the justice delivery system and promotes social equity.
